RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT In consideration of the Release agree to my participation in Hike for Hospice’s 2023 Fire Truck Pull, I hereby agree as follows: 1. To waive any and all claims that I have or may have in the future against the Releasees and to release the Releasees from any and all liability for any and all loss, damage, expense or injury ( including death) that I, or my next of kin, may suffer from my participation in Fire Truck Pull due to any cause whatsoever, including Negligence, Breach of Contract, or Breach of Any Statutory or other Duty of Care on the part of the releasees and further including the failure on the part of the releasees to safeguard or protect me from the risks, dangers, and hazards of participating in the Fire Truck Pull referred to above; 2. To hold harmless and indemnify the releasees for any and all liability to any property damage, loss, or personal injury due to my participation in the Fire Truck Pull; 3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives in the even of my death or incapacity; 4. To agree to give my permission for free use of my name, voice, photograph, video film, and any other form not described, for the purpose of advertising, broadcast, social media postings, regarding the Fire Truck Pull at any time; and 5. I certify that I am at least 13 years of age or older. I HAVE READ THE RELEASE AGREEMENT AND UNDERSTAND THAT I, OR ANY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, AND ASSIGNS, HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THE RELEASE AGREEMENT, AND HAVE SIGNED IT FREELY WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE, INTENDING IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTEND ALLOWED BY THE LAW.
